Is it cheating to ban short selling?

The SEC has temporarily banned the short selling of 799 financial stocks (shorting other sectors is still OK), and that's got people fired up today. The SEC says the move will "restore equilibrium to markets" and help fight market manipulation.

But isn't banning shorts manipulation in itself? That's what David Weidner of MarketWatch is asking today. "Our complaint through history about countries that try to influence their markets by changing the rules mid-game was that it was tantamount to cheating," he writes. "For all of its faults, the U.S. markets were supposed to be the most level playing fields in the world."

Portfolio's Felix Salmon thinks the shorters are going to head over to the options market, which could drive down the price of call options.

Henry Blodget says the ban is outrageous, and will make the market less efficient and hurt some investors' ability to make money. Stocks will shoot far higher now than they would have if shorts had been around, he writes.

The short sellers, of course, are not pleased. "This is borderline insanity," said short seller William Fleckenstein to CNN. "If the SEC had set out specifically to make the liquidity problems worse, they couldn't have done a better job."

So, uh, does anyone like the ban? New York attorney general Andrew Cuomo does, calling shorters "looters after a hurricane." In normal conditions, people hear rumors and they spend time checking it out, Cuomo told the New York Times. But in this frenzied market, where people are on pins and needles, he says, false information can blow up fast.

why not short sell? If everyone is that stupid they should not be in the game! What ever happened to a free market? Why is it that when the little guy is in the position to profit, big brother has to step in and slap their hand and say no, you can't do that! Besides, playing the stock market is gambling any way you look at it period! Vegas doesn't pay back money to the dumb asses who lose it. The government should step aside and let the market play its self out. Remember, its easier to spend someone elses money like the tax payer $ Its all minipulated BS.I am pissed at our gov, for being such *** heads! They want to fix everything all the time! I would be in jail if i did the things that the wall street good o boys are doing! Oh thats right, they are all best friends!

Make it fair. Ban both puts and calls. Market is being manipulated by the government to avoid a crash or bear market and recession. Market correction is coming with or without shorts...

It's an interesting scapegoat: Blame the evil short sellers. Although when stocks go up and the shorts get creamed no one seems to feel sorry for them or attempt to assuage their losses.

Ah well. Some people believe that life is a place where (to paraphrase Carrol) "Everyone wins, and we all get presents". Unfortunately that sort of happy deception just leads to more misery down the road. People are welcome to ban shorts, they are welcome to invest federal dollars in an attempt to "save the market", and they are welcome to play along in what is quickly becoming a massive Ponzi scheme. However they should take a bit of time and see what happened in (say) Albania when that sort of thing runs it's course.

Author starts out with a good premise and devolves into quoting scattered spin. Point is.. if you are going to ban NAKED short selling for one area of the market and let it continue for the rest of the market, that in itself is going to drive NAKED short selling unfairly to devour the other stocks... In effect, it is bald manipulation of the market and inherently UNFAIR. I'd love to see a class action of companies sue the SEC et al over this....  This is where they've shown their true faces.. They don't care who they hurt as long as their good ole boys get a parachute...  Anyone with a tenth of a brain should be able to see this.  If naked short selling is to be banned (as I believe it SHOULD), let it be banned for all... make it a level playing field...  

Laws in place don't mean crap unless you have an Executive Branch willing to prosecute the laws of the land, one that plans to stand by the oath taken to uphold the offices entrusted to them.  

I'd love to see the facts and figures of resources that were available and/or were used to carry out the monitoring of the market in accord with the law as it is... (I'm fairly sure that will be used as an 'excuse' as to why 'we weren't able to enforce the laws'. Then, I'd like to see where in these bailout plans they attempt to 'fix' their inability to have upheld the duties of their offices.

This was planned for.  A lame duck President and its administration is the most dangerous time for America..

I'd love to see a plan in place to prosecute for treason the moment Bush decides to make known who and what he includes on his parting "Pardon" giftlist.

so the hundreds of thousands of average americans who benefit from the new found market stability from the short selling ban dont outweight the needs of a couple dozen who are filthy rich and want even more money that they wont use or need?  i am tired of overly wealthy people crying and moaning about not being allowed to take advantage of America.  short selling is obviously a bad idea that has been ruining the stock market for the last few months, and everyone knows its a bad idea otherwise the markets would not have shot up like they have.  I work very hard for what i have just to have some loser who never worked a day in his life to sit at his desk and manipulate loopholes in the system to find ways to take my money without earning it.  Sit there and cry to me because you have more money than you will ever use, wealth obtained from the labor of americans.

we need to vote no to all in congress running for re-election and no to all incumbents, and fill the place up with people who are not hopelessly lost in the corruption.  i dont know how many out there feel this way, but i have felt for a long time that this system is not quite broken but its not running on all cylinders either, and it keeps getting worse as those in power allow those with wealth to find new ways to cheat us out of our hard earned money.  this nation is wealthy and powerful because of the daily work of average americans, not because this handfull of buffoons that are making the rest of us look bad by lying and cheating and stealing and pretending that none of us are intelligent enough to notice.  we need people in power who will regulate and oversee and manage OUR wealth not funnel it into the pockets of these underhanded petty thieves.  I am tired of my life getting continually harder to afford as the years go by and constantly having to stuggle because of a limping system that nobody will fix.  we need politicians who will do better than take the money and look the other way, there is no way that those we have in charge of us right now are the best people for the job, we are better than that i am absolutely certain

I agree with Cuomo. When people are in love with money rather than honor, their behavior can easily become reprehensible.  If you had avaricious teenagers in your home, would you sanction their schemes or try to prevent them?  We have here the country we deserve, where Christmas is more of a commercial venture than a religious celebration and seats at the local temple are on sale at Yom Kippur.  Money is a convenience in human affairs.  The love of money may not be the only root of evil, but it can go a long way towards destroying people's humanity.

I hope for a permanent ban on short selling.  If you want to own a stock-buy it.  If you think a stock will drop-sell it or don't buy it.  The entire system of shorting stocks has turned the stock market into gambling hall and it needs to stop.
