Dell in hot water for deceptive advertising

Dell had better make headlines with its earnings call tomorrow, if for no other reason than to bury the news out about its misleading advertising practices. A New York judge came down hard on the company yesterday for baiting customers with financing promotions that it never intended to actually offer.

Dell offered freebies and no-interest financing to "well qualified" or "best qualified" customers, according to the judge. But most customers who took the bait were given interest rates from 16% to 30%. The judge also faulted Dell for shoddy customer service that included long telephone holds and denying rebate requests. The judgment had little impact on Dell shares, which are up 3 cents today to $21.52.

Dell said it disagreed with the judge's decision, but hadn't decided whether to appeal. I think an appeal is unlikely; why would the company revive such a damaging case? The question now is if other states will follow New York in suing the company. New York's attorney general has received 1,000 complaints against Dell, and I'm sure other states are hearing from customers as well. (New York customers can apply for restitution at www.nyagdell.com).

On to the earnings report. Dell is in turnaround mode after a miserable year in 2007, when profits tumbled and revenue barely grew. Key to the turnaround is a new strategy to place Dell products in more stores here and overseas. Although Dell still lets people custom-order a PC, it's focusing more on pre-made models that it ships to stores. Dell is making solid inroads in Asia, getting its computers into electronics chains like Suning and Gome in China.

Analysts are expecting Dell to report a Q1 profit of 33 cents per share and revenue of $15.66 billion. At this time last year, Dell reported profit of 34 cents per share and $14.6 billion in revenue.

Dell shares have been creeping up in the last three months, and Morgan Stanley recently upped Dell's rating to overweight with a $28 price target.   

Update: Dell's Q1 results are in, and it looks like the company beat expectations. Revenue hit $16.1 billion, and profit was 38 cents per share. A highlight of the quarter: Notebook computer sales were up 43% from the year before.

I was a sucker who purchased a Dell, NEVER again... Customer service sucks and hold times are FOREVER

Dell has had bad service for years & someone is actually saying so now?

As an independent computer service company, Dell has been good for my business.  With the way they have been operating, I get more service calls from unhappy customers, I have had some as soon as three days after receiving a new Dell.

When customers only buy price, they pay in after market service, I love it

After talking to Dell guy and bought a computer and thereafter has question for the guy, you will never ever be able to succeed finding the guy!

If not Dell, what did you get?

I did get a dell to my ever lastng shame and regret.  I am still paying for it the loan which has a 27% interest rate.  Howeverr the computer has not been working for about two years, it should have been fixed under warranty however I spent 6 hours on the phone with dell one day only to be told repetedly that my name was not in the system even though I had a loan and was still paying for the computer.  NEVER GET A DELL!!!!!!

I got screwed by DELL three years ago........

I ordered what I THOUGHT was a computer and printer from them, only to come home a few days later, and find a PRINTER, PRINTER CABLES, and INK CARTRIDGES waiting for me...

Since it wasn't what I ordered, I boxed it all back up and sent it back to Texas, to their warehouse.

 For the next EIGHT MONTHS, I kept getting bills & late notices in the mail, so everu time I got one, I e-mailed DELL customer service to explain I sent all the items back...Apparently, the Pakistanis I spoke to each time couldn't understand ENGLISH.  It didn't end there...THEN, DELL REPRESENTATIVES started phoning my house at ALL HOURS of the day and night, DEMANDING their payment.....

For whatever reason, they weren't intelligent enough to figure out what I was trying to explain; that all their merchandise was on its way back to the warehouse....I also e-mailed DELL FINANCIAL SERVICES the tracking number, time, date AND location the package was shipped FROM, and the location it was going TO, including the full and complete street address of the warehouse, and DELL STILL wanted their money...FINALLY, after much discussion, yelling and arguing with them, I just got tired of fighting with them and told DELL not to EVER call me again, or I would take legal action against them.

Apparently the sub-moronic cretins DELL has working in customer service couldn't understand my explanation either, because DELL turned my account over to a collection agency in Nebraska who threatened me with legal  action, and, or garnishment of my wages. I promptly protested their action, and sent them copies of all e-mails between myself and the mental wizards at DELL, with a notation to pay particular attention to two pages of the correspondence that stated DELL FINANCIAL SERVICES would credit my account, and put a ZERO BALANCE on it.

  I also told the collection agency that if I was harrassed by either them, or DELL, that I would sue BOTH of them...

  Apparently, there were a few ENGLISH SPEAKING employees at the collection agency, because I have not heard from either company for a while.

   Given my past experience with DELL, I have saved all their e-mails (80 in total), and will hang on to them for safe keeping, should the need arise again to correspond with them.

  I will go so far as to say that after what I had to deal with in my experience with DELL, DELL CUSTOMER SERVICES, and DELL FINANCIAL SERVICES, I can safely say that I would NEVER purchase ANYTHING from DELL, and I take every opportunity to discourage everyone I can from doing ANY business with them.....

  Word of mouth can either MAKE or BREAK you, and it looks like the fine employees at DELL have outdone themselves with deceptive advertising and stupidity this time....

  I wish any and all a lot of luck when dealing with DELL.....YOU'RE GONNA NEED IT!!!!!!!!!!

Speaking of Dell.  Terrible Terrible. I have a Dell laptop.. waste of money.Please if your thinking of getting a laptop or computer consider other options. Enough said

I love my Dell pc... and was one who fell for the great financing option. I was also one who didn't get that great financing option of interest free or even 16% and I have a FICO of over 700. Fortunately, I was in a position to be able to pay my purchase off before the end of the month so I could avoid any finance charges. And I am happy with my DELL PC, great product, great price.

Dell is a good company
