Dell in hot water for deceptive advertising

Dell had better make headlines with its earnings call tomorrow, if for no other reason than to bury the news out about its misleading advertising practices. A New York judge came down hard on the company yesterday for baiting customers with financing promotions that it never intended to actually offer.

Dell offered freebies and no-interest financing to "well qualified" or "best qualified" customers, according to the judge. But most customers who took the bait were given interest rates from 16% to 30%. The judge also faulted Dell for shoddy customer service that included long telephone holds and denying rebate requests. The judgment had little impact on Dell shares, which are up 3 cents today to $21.52.

Dell said it disagreed with the judge's decision, but hadn't decided whether to appeal. I think an appeal is unlikely; why would the company revive such a damaging case? The question now is if other states will follow New York in suing the company. New York's attorney general has received 1,000 complaints against Dell, and I'm sure other states are hearing from customers as well. On to the earnings report. Dell is in turnaround mode after a miserable year in 2007, when profits tumbled and revenue barely grew. Key to the turnaround is a new strategy to place Dell products in more stores here and overseas. Although Dell still lets people custom-order a PC, it's focusing more on pre-made models that it ships to stores. Dell is making solid inroads in Asia, getting its computers into electronics chains like Suning and Gome in China.

Analysts are expecting Dell to report a Q1 profit of 33 cents per share and revenue of $15.66 billion. At this time last year, Dell reported profit of 34 cents per share and $14.6 billion in revenue.

Dell shares have been creeping up in the last three months, and Morgan Stanley recently upped Dell's rating to overweight with a $28 price target.   

Update: Dell's Q1 results are in, and it looks like the company beat expectations. Revenue hit $16.1 billion, and profit was 38 cents per share. A highlight of the quarter: Notebook computer sales were up 43% from the year before.

I have 2 Dells. Never again. I have nothing but problems. And Dell's customer service stinks. I still do not have what I ordered from them 2 years ago.

Yes i  had the same probleum, I bought a pc and being my second purchace with an open exc. standing paying history got nailed for 29.99 %, called and never got a responce and my request was never answered. What a company, I told them no more dell, Toshiba will be from now on. I think my probleum is ordering on line ,Circut city will be my choice from now on.

Although their shares may be up, their products and service has become increasing worse over the years.  That is probably why they need "false advertisement".  The product and service used to speak for itself.  No more

I have purchased several dells and I will NOT be getting another one.  

I never would own a Dell.  thr name alone turnes me off, but when the college I attended decided to unload dell and gateway computers, that was a sign for me not to get a Dell.

I now have Toshiba and Apple computers only.

Like so many companies overseas appears to be the current wave.  Never mind the hang ups, disconnected calls, breakdown in simple communication – try asking for someone “in-charge” that can make a decision.  I purchased items on a gift card and had a balance due (total purchase was over 200.00).  Upon entering in a second card for the 7 dollar and change difference (balance remaining after a gift card was used) I thought I was all done.  3 days later I check my bill and guess what the entire balance was charge to my 1 card, and the gift cards had full balances left.  Do you think calling customer service, being bounced around for 4+ hours (that’s the truth) my only resolution was to send the items back and repurchase them.  Waste of time and money!!  If I wanted to go overseas I’d take a trip, but unfortunately it seems every time you call a customer service # you end up in India, Indonesia, or some place that begins with “IN”.  I own a 2008 Saturn and received a follow up call regarding my service – much to my surprise the spoke English and the conversation was pleasant.  Before ending the call, I asked where they were calling from.  Much to my surprise it was California, for which I responded “nice to know some things are still in the US”.

I have a Dell laptop as well as every member in my family. While the ads may have been misleading .. what company hasn't done that? Aside from this ordeal, I've been very happy with Dell.

If they can do this to Dell why not the car companies that also promise the 0 percent financing for well qualified buyers?  If I were to be taken to the bank I would rather do it with $1,500 than $35,000!

I will never buy a Dell again.  I used to love this company, but like many others in corporate America, greed got the best of them and they think consumers are just stupid.  Dell is now like a sink hole...just keeps getting deeper and deeper and losing customers left and right. Microsoft is next with it's Windows OS...they just keep putting band-aid over band-aid on the OS instead of coming up with something really cool and great like Apple.  Hello Mac!!!

Glad I didn't get a Dell either.  Reading this makes me even less interested in purchasing a Dell computer.
