Bank of America customers, here's some good news for you: If you paid an overdraft or over-limit fee after using a BofA debit card in recent years, you may be able to apply for $78.

The proposed lawsuit settlement, reported by TopClassActions.com, covers a time period from Dec. 6, 2000, to Dec. 31, 2007. It may also apply to customers of several other banks.

Other details:

At the rate these class-action settlements are coming out -- covering things like diamonds, overseas credit card transactions, cosmetics and ring tones -- you could almost consider them a source of passive income.

The BofA lawsuit alleged that it "encouraged its customers to use Bank of America debit cards and increased the number of fees charged to customers using Bank of America debit cards through the order in which such transactions are posted and the account balance information it provides," according to the settlement Web site. Translation: It charged overdraft and over-limit fees that it shouldn't have. The bank did not admit to wrongdoing in the proposed settlement.

To be eligible for up to $78, you must submit a claim by May 9. TopClassActions.com says the online form takes no more than two minutes to complete. First, determine your eligibility by reading this .pdf file.

Free cosmetics update: On Jan. 20, shoppers lined up at many department stores for free cosmetics made available because of another class-action suit. The one-item-per-customer distribution will last through Jan. 26 but end earlier if supplies run out, which has most likely happened at many locations. Call the store first before you make a wasted trip.

BofA is one bank I would have nothing to do with the way the battle creek mi. office does its business

about time, BOA is a criminal organization....what they did was deduct charges and checks using the BIGGEST one first, not the ORDER they were written in.  thus your account goes in the red faster and you pay overdraft fees on multiple smaller checks rather than pay the smaller checks and one overdraft fee for the big check you wrote LAST.

Come on, BoA need admit their wrongdoing. The customer is not stupid.

National City Bank should be next.

Overdrafts shouldn't even happen with a debit card anyway. They are supposed to be on a "live" system and should come out of you bank right away. If any overdrafts occur it should be on checks and autopays not debit cards. I would have complained right away, but the way banks and every other financial establishment is anymore it's screw the customer not rewards them.

Where do I sign up for all of this free money?  I lost my job and we are barely holding on.  Bills are late, food is scarce, no new or used clothes.  I also need help.

I have a two questions: Why can't President Obama place a moratorium on the forclosure of all mortages currently awaiting review for modification? Also what would taking the money from one of these large bail out packages such as the eight billion sitting on the table now and applying it directly to paying off those mortgage obligations do? Homeowners could then make pay back directly to a fund managed by the government according to assessed value and proportionate to their income guidlines?

I think we already have the answers in place! We just need to implement them.

All banks including BofA do the bait and switch but if you do bill pay and bank on line AND check your account every day you can get ahead of the problems.  Having to do a class action and sue and only get back a maximum of $78 for your grief is a victory but it's so much better to prevent stuff like this in the first place.  They should have also beeen made to go back and take the negative info they put on your records off since that effected their credit bureau and their future ability to get credit etc...not just the $$ the bank took illegally by making up rules so they could steel from their unwary customers.

get chase too!

Once again does the word "GREED" mean anything?  Look at the amount that a person who was affected gets $78 and look at what the attorney gets $ 8,125,000. Is there any wonder why this country is in the shape it is in.....These attorneys need to be disbarred....Shame on the attorneys and those that approve it...Shane on them.
